There are restrictive conditions registered in title deeds of properties in many of the older townships that place limitations on the use of the property and/or the way it is developed. Today, development and land use are controlled by zoning schemes, but title deed conditions remain legally binding as well. It often happens that there are two sets of binding, yet conflicting rules for one property.
When an owner applies for a new use or relaxations from the Zoning Scheme provisions, title deed conditions may still restrict or even prevent development from being implemented. In such a case, Planning Space can apply to have the restrictions amended, suspended, relaxed, or even removed entirely from the title deed.
